Consent decree

A consent decree is a settlement that a court adopts as its own order. Rather than litigate to judgment, the parties negotiate terms — often injunctive steps, a compliance schedule, and penalties — and the court enters them, so the agreement becomes judicially enforceable and stays under the court's supervision until its obligations are met.

In the environmental record the consent decree is the usual endpoint of a serious enforcement track: a discharger in significant non-compliance, or a party liable under CERCLA, resolves the matter by agreeing to a decree that fixes what it must do and by when. Because it is a public court document, a consent decree is a high-value, [verified] source — it states the violations conceded, the remedy imposed, and the deadlines that follow, and it often surfaces in ECHO as the formal action that closed out a compliance case.
