Conditional use

A conditional use is a use the zoning code lists as permissible in a district but only with discretionary approval — the applicant must show it meets standards and accept conditions attached to it. It is decided administratively or by a zoning board, not by the legislature, which distinguishes it from a rezoning: the underlying district does not change, the use is simply cleared within it.

The conditional-use path lets a project avoid a full rezoning fight when its zoning already contemplates the use, trading a legislative vote for negotiated conditions — buffers, hours, traffic or utility commitments. For the record, the value is in those conditions: they are where a community extracts concrete obligations from a data-center or industrial user, and where a later dispute over compliance is anchored. A conditional use is a narrower instrument than a variance, which waives a standard rather than authorizing a listed use.
